Actions by cappusa.com for nonpayment of products by the Purchaser, or for redress of other breaches by the Purchaser or potential customer of the Access Terms, Purchase Terms, and/or Sales Policy, may be brought by cappusa.com, at its option, before any judicial court of competent jurisdiction. At the option of cappusa.com, disputes between the Purchaser or potential customer and cappusa.com, including all claims for non-performance by cappusa.com, shall be finally settled by arbitration within the Commonwealth of Pennsylvania, Delaware County, Pa. U.S.A. under the rules of the American Arbitration Association, which rules with respect to matters not regulated by them shall incorporate the UNCITRAL arbitration rules by one or more arbitrators appointed in accordance with said rules applying these terms and conditions contained herein and consistent provisions of the internal laws, except conflict of law rules, of the Commonwealth of Pennsylvania, Delaware County, PA., U.S.A.
