LIMITED WARRANTY:

All products sold are warranted by cappusa.com only to Purchasers for resale or for use in business. All products are warranted by cappusa.com against defects in workmanship or materials under normal use for one (1) year after date of purchase from cappusa.com, unless otherwise stated in writing. Any product which is determined to be defective in material or workmanship and is returned to cappusa.com, as cappusa.com designates, shipping costs prepaid, will be, as the exclusive remedy, repaired or replaced, at cappusa.com’s option.

WARRANTY DISCLAIMER:

NO WARRANTY OR AFFIRMATION OF FACT, IMPLIED OR EXPRESS, OTHER THAN AS SET FORTH IN THE LIMITED WARRANTY STATEMENT ABOVE IS MADE OR AUTHORIZED BY CAPPUSA.COM. CAPPUSA.COM DISCLAIMS ANY LIABILITY FOR PRODUCT DEFECT CLAIMS, WHETHER OR NOT DUE TO PRODUCT MISUSE, IMPROPER PRODUCT SELECTION AND/OR MISAPPLICATION, AND ANY DESCRIPTION DOES NOT EXPRESS OR IMPLY A WARRANTY THAT THE PRODUCT(S) ARE MERCHANTIBLE OR FIT FOR A PARTICULAR PURPOSE.

LIMITATION OF LIABILITY:

ANY LIABILITY FOR INCIDENTAL, INDIRECT, SPECIAL, STAUTORY, AND/OR CONSEQUENTIAL DAMAGES IS EXPRESSLY DISCLAIMED. CAPPUSA.COM’S LIABILITY IN ALL EVENTS IS LIMITED TO, AND SHALL NOT EXCEED THE PURCHASE PRICE PAID.

PROMPT DISPOSITION:

As always, cappusa.com will make a good faith effort for prompt correction or any other adjustment(s) with respect to all products which prove to be defective within their warranty period. Before returning any product(s), please CONTACT CAPPUSA.COM so that the proper Return Material Authorization (RMA) No. can be issued. The title and risk of loss pass to the Purchaser on the delivery to the common carrier.

MANUFACTURER’S WARRANTIES:

Most of the products cappusa.com supplies are warranted by the manufacturer of the product. Copies of all manufacturer’s warranties are available from cappusa.com free of charge. To obtain copies of manufacturer’s warranties, please CONTACT CAPPUSA.COM.

FORCE MAJEURE:

Cappusa.com shall not be liable for any delay in or impairment of performances resulting in whole or in part from Acts Of God, Labor Disruptions, Severe Weather, Insurrections, War, Shortages, Governmental Decrees, Inability to procure and/or ship products or obtain permits and licenses, or any other circumstances and causes beyond the control of cappusa.com.

ORDER CANCELLATION:

Cancellation of any order(s) must be approved by cappusa.com and may be subject to restocking or other charges.

COPYRIGHTS AND TRADEMARKS:

Customers and potential customers acknowledge that they have no right, title, or interest in the copyrights or trademarks in the products, and they covenant that they will take no action to register or otherwise interfere with such rights.

Cappusa.com makes every effort to keep all product information and specifications accurate and up to date, however cappusa.com is limited by the manufacturers of products and their ability to provide product information. THEREFORE, CAPPUSA.COME MAKES NO WARRANTIES, IMPLIED OR EXPRESS, AS TO THE ACCURACY OF THE DATA IN ITS ELECTRONIC ON-LINE CATALOG(S).

HAZARDOUS PRODUCT INFORMATION:

SEPARABILTY:

In the event that any provisions of these Purchase Terms are deemed illegal or unenforceable, such illegality or unenforceability shall not affect the validity and enforceability of any other legal provisions hereof which together shall then be construed as if such illegal and unenforceable provision or provisions had not been inserted herein, unless such illegality or unenforceability shall destroy the underlying business purpose of the Purchase Terms.

COMPLETE AGREEMENT:

The terms and conditions set forth in cappusa.com’s Purchase Terms, Access Terms, Sales Policy, Forms, Acknowledgements, Invoices, Quotations, Catalogs, and/or Packing Slips, are incorporated herein by reference and constitute the entire and exclusive agreement between the Purchaser and cappusa.com.

MODIFICATIONS TO TERMS:

Cappusa.com reserves the right to amend, change, and/or modify any or all of its Terms and Policies at any time.
